Introduction
Welcome to HM Landscaping. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our website or use our services.
Services Description
HM Landscaping provides landscaping and gardening services, including but not limited to lawn mowing, softscape installation, sprinkler system installation and maintenance, and snow removal. The specific services to be provided will be detailed in a written estimate or contract between HM Landscaping and the client.
Estimates and Pricing
All estimates provided by HM Landscaping are valid for 30 days from the date of issuance. Prices are subject to change without notice after this period. Estimates are based on the information provided by the client and visual inspection of the property. If additional work is required due to unforeseen circumstances or conditions, additional charges may apply.
Payment terms will be specified in the estimate or contract. Unless otherwise stated, payment is due upon completion of services for one-time services, or according to the agreed-upon schedule for ongoing services.
Service Scheduling and Cancellations
HM Landscaping will make every effort to provide services at the scheduled time. However, we reserve the right to reschedule services due to inclement weather, equipment failure, or other unforeseen circumstances.
Clients must provide at least 48 hours' notice for cancellation or rescheduling of services. Failure to provide adequate notice may result in a cancellation fee of up to 50% of the scheduled service cost.
For ongoing service contracts, clients must provide at least 14 days' written notice to cancel services. Any prepaid amounts for services not yet rendered will be refunded, less any applicable cancellation fees.
Client Responsibilities
Clients are responsible for:
- Providing accurate information about the property and desired services
- Ensuring that the property is accessible to HM Landscaping personnel and equipment
- Marking or identifying any underground utilities, irrigation systems, or other features that could be damaged during service
- Securing pets and removing any obstacles that could interfere with service provision
- Promptly communicating any concerns or issues regarding the services provided
Warranties and Guarantees
HM Landscaping guarantees all workmanship for a period of 30 days from the date of service completion. This guarantee does not cover damage due to acts of nature, improper maintenance by the client, or normal wear and tear.
For plant materials, warranties may vary depending on the type of plant and will be specified in the contract. Generally, trees and shrubs are warranted for one growing season, provided they are properly maintained by the client according to our care instructions.
Irrigation systems are warranted for one year from the date of installation against defects in materials and workmanship. This warranty does not cover damage due to freezing, improper winterization, or physical damage.
Limitation of Liability
HM Landscaping's liability is limited to the cost of the services provided. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or in connection with the use of our services.
HM Landscaping is not responsible for damage to unmarked irrigation systems, utilities, or other underground features. It is the client's responsibility to mark or identify these features prior to service.
Insurance and Licensing
HM Landscaping maintains general liability insurance and workers' compensation insurance as required by law. Proof of insurance is available upon request.
All necessary licenses and permits required for the provision of our services are maintained in accordance with local, state, and federal regulations.
Dispute Resolution
Any dispute arising from or relating to these Terms or the services provided shall be resolved through good-faith negotiation between the parties. If negotiation fails to resolve the dispute, the parties agree to submit to mediation before pursuing any other remedy.
These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without giving effect to any principles of conflicts of law.
Intellectual Property
All content on the HM Landscaping website, including text, graphics, logos, images, and software, is the property of HM Landscaping or its content suppliers and is protected by United States and international copyright laws.
The compilation of all content on this site is the exclusive property of HM Landscaping and is protected by United States and international copyright laws. The reproduction, modification, distribution, transmission, republication, display, or performance of the content on this site is strictly prohibited without the express written consent of HM Landscaping.
Changes to Terms
HM Landscaping reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website. Your continued use of our website or services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.
